In January 2026, the Danish Ministry of Children and Education published a new practical guide to help educational institutions ensure the lawful and responsible use of artificial intelligence (AI) in teaching, administration and student support. The guide supplements earlier national guidance issued in 2025 and provides concrete examples and clarifications tailored to everyday practice in education and training institutions, including vocational education and training (VET).
As AI tools are increasingly used by both teachers and students, schools face growing questions about data protection, copyright, transparency and the responsible use of generative AI. It highlights key legal considerations when institutions or teachers use AI systems that process personal data, for example in learning platforms, automated feedback tools or generative AI assistants.
Among the central themes are:
- ensuring that personal data are processed lawfully and securely
- assessing whether AI tools comply with public-sector data-protection requirements
- understanding how copyright rules apply when AI systems generate text, images or other content
- clarifying responsibilities for institutions, teachers and students when AI is used in learning activities
The guide emphasises that institutions remain responsible for ensuring that digital tools, including AI systems, comply with applicable legislation before they are adopted in teaching or administrative procedures.
Supporting responsible use in teaching and learning
Rather than discouraging AI use, the initiative seeks to enable the safe and pedagogically meaningful integration of AI technologies. The ministry stresses that AI can support learning and teaching when used transparently and with clear guidelines for students and staff.
For example, institutions are encouraged to establish local policies that describe how AI may be used in assignments, exams and teaching activities. Clear expectations help prevent misuse while allowing students to develop critical and responsible AI competences that are increasingly relevant in working life.
